This agreement, here-in-after referred to as “Agreement”, constitutes a binding contract between you and Claartje van Andel, acting under the name dressagedirect.com and here in after referred to as “dressagedirect.com” and governs and rules your use of both the subscription and free areas of dressagedirect.com here in after referred to as the “Service". By accepting this agreement and registering yourself or your organization as a subscriber, you accept the regulations of this Agreement, and you represent that: a) you have read and understood this Agreement and agree to be bound by its terms and b) that you are at least 18 years of age.
The terms of this Agreement may be amended by dressagedirect.com from time to time in its discretion, and a copy of such amended terms will be posted at www.dressagedirect.com. You will be considered as deemed to have accepted the Agreement as amended 30 days after the amended terms are posted if you continue to use the Service. In the event of such amendment, all other terms of the Agreement will remain in effect.
Registration
In order to become a subscriber to the Service of dressagedirect you must register and provide specific information. You represent that your subcription information will be updated, accurate and in a complete form at the time you subcribe and that you will update this information as often as necessary. For registration and sign-in purposes, you will select your own chosen user name and password.
Billing
By completing the subscription application process you may choose to pay the fee by opening your own account at paypal or you authorize dressagedirect.com to charge the quarterly respectively yearly subscription fee in advance to your designated credit card by PayPal. If your billing information changes, you must update that information by logging into my PaySystems using the information provided to you in your initial receipt and welcome email. If you cancel your subscription for any reason, dressagedirect.com will not refund any remaining portion of your subscription fee. The subscription fee will be revised once a year in November of the current year.
Refund Policy
Please note that dressagedirect.com maintains a ‘no refund’ policy on memberships.
Termination of usage
dressagedirect.com may terminate your access to all or parts of the Service, without notice, for any conduct that dressagedirect.com, in its sole discretion, believes is in violation of this Agreement or applicable law, or is detrimental to the interests of another user or any third party. In such case, dressagedirect.com shall have no liability to you, and dressagedirect.com will not refund any portion of your subscription fee.
Intellectual property rights
You agree that all content on the Service, including text, graphics, photographs or video presentations and other material here in after referred to as “The Content”, and the enhancement, coordination, selection, arrangement and of same, is the exclusive property of dressagedirect.com or the property of content suppliers to dressagedirect.com and is protected by copyrights, trademarks and/or other proprietary rights. All future and present copyrights, trademarks and other proprietary rights in and to the Content shall at all times be and remain the exclusive property of dressagedirect.com and its content suppliers. The Service includes materials whose property rights, trademarks and copyrights are owned and controlled by third parties. Use of such material is allowed only with the written permission of the owners of such materials.
Restrictions on use
You agree to use the Content only for lawful purposes, and not for resale or other transfer to, or use by or for the benefit of, any other person or entity.
Limitation of Liability
Under no circumstances, including but not limited to negligence, shall dressagedirect.com be liable to you for any direct or indirect punitive, special, incidental or consequential damages allegedly sustained by you or any third parties from your use of the service or the content or your inability to access or use the service.
Linking
dressagedirect.com may provide hyperlinks to other web sites maintained by third parties or may provide third party content on the Service by framing or other methods. The fact that dressagedirect.com provides links to third parties’ web sites does not mean that we endorse, authorize or sponsor that web site. The links to those web sites are provided for your convenience and information only. We are not responsible for the content of linked web sites. It is up to you to take precautions to ensure that the third party web site to which you link is free of computer viruses and other items of a destructive nature.
Representations and warranties
You represent, warrant and covenant that you: a) have the power and authority to enter into this Agreement; b) shall not use any rights granted herein for any unlawful purpose; and c) shall use the Service and the Content only as permitted by this Agreement.
Indemnity
You agree to indemnify and hold harmless dressagedirect.com and its agents, employees, representatives, licensors, affiliates, parents and subsidiaries from and against any and all claims, losses, demands, causes of action and judgments (including attorney's fees and court costs) arising from or relating to your use of the Content or the Service, including, without limitation, allowing others to use your subscriber name, password and/or account.
Disclaimer
All results and any other data presented by us are put together with the greatest care. dressagedirect.com does not represent or endorse the accuracy or reliability of any of the information, content or advertisements (collectively, the "Materials") contained on, distributed through, or linked, downloaded or accessed from any of the services contained on this website (the "Service"), nor the quality of any products, information or other materials displayed, purchased, or obtained by you as a result of an advertisement or any other information or offer in or in connection with the Service (the "Products"). You hereby acknowledge that any reliance upon any materials shall be at your sole risk. dressagedirect.com reserves the right, in its sole discretion and without any obligation, to make improvements to, or correct any error or omissions in any portion of the service or the materials or to any submissions related to the aforementioned. dressagedirect.com expressly disclaims any and all warranties, express or unimplied with respect to the service of dressagedirect.
dressagedirect.com is a directory, and as such, dressagedirect.com explicitly disclaims any responsibility for the accuracy, content, or availability of Information contained therein. To the extent permitted by law, dressagedirect.com will not be liable for any indirect or consequential loss or damage whatever (including without limitation loss of business, opportunity, data, profits) arising out of or in connection with the use of this website.
Governing law and disputes
This Agreement shall be governed and construed in accordance with Dutch law without giving effect to conflicts of law principles. Disputes shall be settled exclusively by the competent Dutch court.
